On September 2nd 2014, Mike LaPointe, Patrick Mazza, Jackie Minchew, Liz Spoerri and Abby Brockway, members of Rising Tide Seattle, placed themselves in the path of a parked oil train at the BNSF Delta rail yard in Everett, WA. The blockaders had petitions for Governor Inslee to declare a moratorium on oil trains and reject any new permits on fossil fuel expansion project which would create a fossil fuel corridor here in Washington. The five also had a banner showing solidarity with the railroad workers who were advocating safety measures.
At 6:00 AM BNSF crews arrived and found the five blockaders with a metal tripod erected on a siding track, creating an effective blockade in front of the oil train. Mike, Patrick, Jackie, and Liz were each positioned on the ground at the legs of the tripod on the railroad track. Abby was perched at the top of the 18 foot structure.
At 2:30PM, with the help of a ladder truck from the Everett Fire Department, all five were arrested, having successfully blocked the oil train for 8 hours.
They were transported to city hall and then to Snohomish County jail where they stayed overnight. The next morning they were arraigned on charges of trespass and blocking a train.

Trial date is set for January 11th 2016, in Lynwood. We hope that we will be able to present a necessity defense and will be able to put expert witnesses on the stand to argue that 1) there is verifiable imminent danger 2) that we had a reasonable expectation of efficacy in taking our action 3) that we have (and the climate movement has) pursued every available legal alternative.
